Welcome to localbathquote.com (the “Site”). We take your privacy seriously and maintain a separate Privacy Policy. By requesting information or submitting data through the Site, you consent to contact from us and our partners. We are not liable for user activities and make no warranties. Disputes are subject to arbitration on an individual basis.

1. About These Terms of Use

By accessing the Site or its content, you acknowledge agreement to these terms. This agreement is legally binding between you and AdSwapper Inc, the owner and operator of the Site. You must:

• Have the necessary authorization to enter this agreement
• Be a United States resident (including territories)
• Be at least eighteen (18) years of age

You represent that you have authority to bind any entity on whose behalf you use the Site. If you do not agree, you should not access or use the Site. Supplemental terms for specific products or services may apply and will govern over these Terms in case of conflict.

2. Consent and Privacy

By clicking acceptance buttons or submitting inquiries, you agree to these Terms and understand you are submitting inquiries to service providers and third-party companies (“Providers”). Key consent provisions:

• You extend express written consent to be contacted via telephone (including auto-dialed and pre-recorded messages) and email
• You consent to contact even if your phone number appears on Do Not Call lists
• SMS/MMS message and data rates from your mobile provider may apply
• You authorize information verification by Providers
• You authorize adding your contact information to the Site's database
• You may receive marketing calls or emails from the Site and its affiliates

You acknowledge the Site may record digital interactions and may engage outside vendors for compliance activities.

3. Our Services

The Site is NOT a contractor or manufacturer and does NOT provide renovation or installation services.

The Site functions as a venue allowing Providers to offer services to consumers (“Prospects”) who have visited and provided information. Key points:

• The Site does not offer the products or services described on it
• The Site is not involved in transactions between Prospects and Providers
• The Site collects information (“Leads”) and shares it with Providers
• The Site is not responsible for service issues or problems receiving quotes
• The Site operates as an independent contractor for all purposes
• The Site does not endorse or recommend any Providers
• The Site cannot guarantee a Provider will contact a Prospect or provide assistance
• Providers may request additional information before providing a quote
• The Site receives compensation from Providers for displaying advertisements or for submitted forms
• Services and products may not be available in all states
• The Site does not guarantee specific terms or conditions with any Provider

Providers may obtain, verify, and record identifying information to combat identity theft, terrorism funding, and money laundering, including name, address, and date of birth.

4. Personal Use

The Site grants you a limited, revocable, non-exclusive license to access its public portions to view or make inquiries. Prohibited uses include:

• Collection, aggregation, copying, duplication, display, or modification of the Site or Service
• Data mining, robots, spiders, or similar data extraction tools without prior written permission

Limited exceptions exist for general-purpose search engines and non-commercial public archives that comply with robots.txt files.

5. Proprietary Rights and Downloading Information

The Site may immediately terminate access for users engaging in such activities.

7. Changes to Site

8. Data Transmittal

You acknowledge the Site may store and process data at locations within and outside the United States. You consent to information transfer to the United States, and agree transactions are deemed to occur there.

9. Identity Verification

Internet user verification is difficult, and the Site cannot confirm each user's identity. Users should exercise caution with business partners. The Site has no liability for unauthorized transactions using your credentials before notification and reasonable opportunity to act. The Site may suspend or cancel access if it suspects unauthorized or fraudulent use.

10. Limitation of Liability

AdSwapper Inc, its affiliates, officers, members, managers, directors, agents, and employees (collectively, the “Site Group”) are NOT liable for lost profits or data, or for indirect, consequential, special, incidental, or punitive damages, arising from breaches of contract, warranty, strict liability, tort, negligence, or other causes, except where applicable law prohibits such limitations.

If you are dissatisfied with the Site or Service, your sole remedy is to discontinue use. The Site Group's aggregate liability for all claims combined is limited to $100.00.

11. Disclaimer of Warranties

The Site and Service, including all content, software, functions, and information, are provided “as is.” The Site expressly disclaims all express or implied warranties, including non-infringement, merchantability, and fitness for a particular purpose. The Site does not warrant that functions are uninterrupted or error-free, or that the server is free of viruses. Some jurisdictions do not allow implied warranty exclusions, so these exclusions may not apply to all users.

12. Release

If you have disputes with other Site users, including between Providers and Prospects regarding transactions, you agree to release and discharge the Site and all members of the Site Group from any claims, demands, or causes of action arising from or connected with such disputes and/or use of the Site or Service. California residents waive California Civil Code Section 1542 regarding general releases. Residents of other states waive similar statutory protections.

13. Indemnity

You agree to indemnify, defend, and hold the Site Group harmless from liability and costs (including attorneys' fees) incurred in connection with claims arising from your use of the Site, your acts or omissions, or breaches of these Terms.

14. Dispute Resolution

Arbitration

Disputes arising between you and the Site concerning these Terms, the Site, the Service, or submitted data will be resolved by arbitration before the American Arbitration Association per its current commercial arbitration rules (“AAA Rules”), as modified by these Terms. A single arbitrator administers the arbitration and awards are final and conclusive.

You may opt out by notifying the Site in writing at Local Bath Quote, 1601 S Providence Rd, Columbia, MO 65203 within thirty (30) days after submitting your information.

Class-Action Waiver

To the extent permitted by law, you agree not to bring, join, or participate in class action lawsuits, class-wide arbitration, or representative claims against the Site or its affiliates.

Forum for Certain Disputes Not Arbitrated

If arbitration provisions become inapplicable or unenforceable, jurisdiction and venue are exclusively in the state and federal courts of Columbia, Missouri.

15. No Agency

The relationship between the Site and each user is that of independent contractors; no agency, partnership, joint venture, or employer-employee relationship is created.

16. Notices

Written legal notices must be sent by certified postal mail, return receipt requested, to: Local Bath Quote, 1601 S Providence Rd, Columbia, MO 65203, Attn: Legal Dept.

17. Amendments

The Site reserves the right to change, modify, add, or remove any portion of these Terms at any time. Revised Terms become effective immediately upon posting. Continued use of the Site after posting constitutes acceptance of the amendments.

18. Copyright Infringement

19. Links to Third-Party Sites

If any provision is unenforceable, it shall be enforced to the maximum extent possible and the remaining provisions continue in full force. You may not assign your rights under these Terms; the Site may assign or delegate these Terms in whole or part.
